Whether delay in lodging FIR in a motor accident claim case is fatal to the claim under Section 166 of the Motor Vehicles Act?
Delay in lodging FIR is not fatal per se to a motor accident claim. The Court held that in Indian social conditions, family members of the victim prioritize medical treatment over approaching the police. Where delay is reasonably explained, such as hospitalization or death of the victim, it cannot defeat the claim.
